2. The service
Seturack provides KVM virtual servers running on Proxmox. The servers are in Istanbul. The memory, CPU and disk you choose are shown on the order page. Daily backups and unlimited traffic are included in the price.
Unlimited traffic means the amount of traffic has no limit. The network connection is a 1 Gbit port, the line is shared between servers and this speed is not guaranteed. So that servers don't affect each other, the speed may be lowered temporarily during prolonged high network use. Disk speed is limited: the current values are a sustained 500 MB/s and 20,000 IOPS for reads, and 200 MB/s and 8,000 IOPS for writes. Outgoing port 25 starts closed on new servers and can be opened from the panel.
If you pick a one-click app when ordering, it installs itself the first time the server boots. Its address and login details then appear in your customer panel.
We take reasonable care to keep the service running properly. Maintenance, faults or events outside our control can still cause interruptions.
3. Your account
- You must have the legal capacity to enter into a contract.
- The details you give us must be accurate and up to date.
- You are responsible for keeping your password and server details safe. Anything done from your account counts as done by you.
- If you think someone has accessed your account without permission, write to us straight away.
4. Acceptable use
You may not use your server to:
- Send spam, meaning unsolicited bulk email or messages, or set up systems for sending it.
- Attack other systems. This includes denial-of-service attacks, unauthorised scanning, password guessing, unauthorised access, running malware or botnets, and publishing phishing pages.
- Host or publish illegal content, including content that infringes someone else's intellectual property.
- Host, share or facilitate any material showing child abuse. If this happens, we close the service immediately and report it to the authorities.
- Disrupt the network or other customers' services.
If a server sends traffic at a very high speed for a long time, its network speed is temporarily reduced and this is shown in its panel. The speed returns to normal on its own when the time is up.
Turkish Law No. 5651
Seturack is a hosting provider under Law No. 5651. It has no duty to check the content on your server. If it is notified of illegal content as the law requires, it removes that content where technically possible. It keeps traffic data for the period the law sets and gives it to the competent authorities when they ask for it.
You are responsible for what you publish on your server. If you use your server to give others content, hosting or internet access, the duties under Law No. 5651 and related rules fall on you.
5. Managing your server
You get root (full administrator) access to your server. That means you manage the server yourself.
- You are responsible for operating system and app updates, security settings and any software you install.
- One-click apps are installed for you once. After that, maintaining and updating them is up to you.
- You are responsible for the data and content on your server.
6. Third-party software licences
The licences for software installed on your server, by us or by you, are yours. Seturack does not own or license that software.
- If you pick TeamSpeak, you accept the TeamSpeak licence agreement. The free licence is limited to 32 people. If you need more, you buy the licence yourself.
- You must also follow the licence terms of any other software you use.
7. Payment and renewal
The service is sold in monthly or yearly terms, paid at the start of each term. The total including KDV (Turkish VAT) is shown at checkout.
To keep the service after a term ends, the renewal invoice must be paid. If it is not, your server is first suspended and stops running. If payment is still not made, the server and its data are deleted. We do not promise that deleted data can be recovered.
8. Size changes
- Scaling up applies straight after payment. You are invoiced the difference for the remaining days.
- Scaling down is scheduled for the end of the term you have paid for. You can cancel it until the term ends.
- Scaling down does not shrink the disk. The disk and its data stay as they are.
9. Backups
Your server is backed up every night and the last 7 days are kept. This is included in the price. When the service ends, your server's backups are also deleted within 7 days. Backups do not mean your data can never be lost. Keep your own copy of anything important.
10. Suspension and termination
If section 4 is breached, an authority requires it, or there is a threat to security, we may suspend your server without notice and tell you afterwards. For serious or repeated breaches, we may terminate this agreement.
You can cancel the service from the panel at any time. Cancelling stops future renewals. The right of withdrawal is covered in the Distance Sales Agreement.
11. Limit of liability
Seturack's total liability under this agreement is limited to the amount you paid for the service concerned in the 12 months before the event that caused the loss.
We are not liable for indirect losses such as lost profit, lost business, damage to reputation or lost data. We are also not liable for delays or interruptions caused by events outside our control, such as natural disasters, war, orders from authorities or national network outages.
These limits do not apply to intent or gross negligence, or where the law does not allow liability to be limited.
12. Personal data
We handle your personal data as described in our Privacy Policy and KVKK Notice.
13. Changes to these terms
We may change these terms. We publish the current text on this page and update the effective date. We tell you about important changes by email or in the panel before they take effect. If you do not accept a change, you can cancel the service. If you keep using the service after a change, you accept the new text.
14. Governing law and courts
Turkish law governs this agreement. The courts and enforcement offices of Istanbul have jurisdiction over disputes.
If you are acting as a consumer, your right to apply to the Consumer Arbitration Committee and Consumer Courts in Turkey, and any mandatory consumer rules of the country you live in, remain unaffected.
If the Turkish and English texts differ, the Turkish text prevails.
