This document is issued under Turkish Consumer Protection Law No. 6502 and the Distance Contracts Regulation. The pre-information form comes first, followed by the terms of the agreement.

Part 1: Pre-Information Form

2. Buyer

The Buyer is the person or organisation that gives their name, address, email and phone number when opening an account and placing an order.

3. Main features of the service

• A KVM virtual server running on Proxmox, located in Istanbul, Turkey.
• The memory, CPU and disk depend on the size you pick and are shown on the order page.
• Daily backups and unlimited traffic are included in the price.
• If you pick a one-click app, it installs itself the first time the server boots.

4. Price

The total price including KDV (Turkish VAT) and the payment currency are shown at checkout, and payment is taken in that currency. The currency is Turkish lira on the Turkish site and US dollars in every other language; if your billing address is in Turkey, payment is always taken in Turkish lira. The service is delivered electronically, so there is no delivery charge.

5. Payment

You pay by credit or debit card through Iyzico, or from your account balance. The site does not store your card number. Payment is taken in advance for the monthly or yearly term you choose. If you save your card and turn on auto-pay, the renewal fee is charged to that card before it is due; you can turn off auto-pay or remove the saved card at any time under Account Settings > Saved Cards.

6. Start of service

The service starts electronically right after your payment is confirmed. The server is created automatically. One-click apps usually finish installing within a few minutes. The address and login details appear in your customer panel.

7. Duration

The minimum duration of the agreement is the payment term you choose. The service continues for as long as each renewal invoice is paid at the end of a term.

8. Right of withdrawal

There is no right of withdrawal for this service. The service is performed electronically and immediately, and performance begins with your consent before the withdrawal period ends. Under Article 15(1)(ğ) and (h) of the Distance Contracts Regulation, consumers cannot use the right of withdrawal for contracts of this kind.

By completing your order, you confirm that you want the service to start immediately and that you know you therefore cannot withdraw. Your statutory rights if the service is defective remain unaffected.

9. Complaints and disputes

You can send complaints to the address above or to [email protected]. For disputes, you can apply to the Consumer Arbitration Committee within the monetary limits set each year by the Ministry of Trade, or to the Consumer Court above those limits.

Part 2: Distance Sales Agreement

Article 1: Subject

This agreement covers the virtual server service the Buyer orders on seturack.com, and the rights and duties of the parties under Law No. 6502 and the Distance Contracts Regulation. The information in Part 1 forms part of this agreement.

Article 2: Formation

The agreement is formed when the Buyer confirms the pre-information, completes the order and payment is received. You can read this text on this page and find your order summary and invoice in the customer panel.

Article 3: Price and payment

The price is the amount including KDV shown at checkout, as described in Part 1. The Buyer pays it using the chosen payment method.

Article 4: Performance

The Provider starts the service electronically right after payment is confirmed and makes the login details available in the customer panel.

Article 5: Renewal

The service continues if the renewal invoice is paid at the end of the term. If it is not, the service is first suspended. If payment is still not made, the server and its data are deleted.

Article 6: Right of withdrawal

As stated in section 8 of Part 1, the right of withdrawal cannot be used for this service.

Article 7: Terms of use

The Terms of Service and Acceptable Use also apply to your use of the service. Personal data is handled under the Privacy Policy and KVKK Notice.

Article 8: Buyers who are not consumers

A Buyer who purchases the service for commercial or professional purposes is not a consumer. In that case, the rights Law No. 6502 gives to consumers do not apply.

Article 9: Governing law and disputes

Turkish law governs this agreement. A Buyer who is a consumer may apply to the bodies listed in section 9 of Part 1. Any mandatory consumer rules of the country you live in remain unaffected. The courts and enforcement offices of Istanbul have jurisdiction over other disputes.

If the Turkish and English texts differ, the Turkish text prevails.
